Licensing procedures

1. Procedure of Hydrocarbon (HC) prospecting

HC prospecting (pre-investigation) licences are issued without a competition based on an application. That licence is not exclusive.

Licensing procedure:

An applicant interested in hydrocarbon pre-investigation submits an application to the Ministry of Economics (Annex 1 to Regulations of the Cabinet of Ministers No. 597) for the determination of a prospecting licence area.

The Cabinet of Ministers either approves or rejects the prospecting licence area proposed by the applicant.

If the Cabinet of Ministers approves the licence area proposed by the applicant, the applicant submits an application to the Ministry of Economics (Annex 3 to Regulations of the Cabinet of Ministers No. 597) for the issue of a licence for HC prospecting.

After the receipt of the application from the applicant, the Ministry of Economics prepares and issues the licence for HC prospecting.

 

 2. Procedure of HC Exploration and Production (E&P)

 2.1. Licences for HC E & P for the offshore areas and onshore territories, which are the state property, are issued based on a competition. The competition could be initiated either by the state (represented by the Ministry of Economics) or by any applicant interested in conducting HC E & P operations. The licence is exclusive.

Licensing procedure:

 An applicant interested in hydrocarbon exploration and production, submits an application to the Ministry of Economics (Annex 1 to Regulations of the Cabinet of Ministers No. 597) for the determination of an E & P licence area.

The Cabinet of Ministers either approves or rejects the E & P licence area proposed by the applicant.

If the Cabinet of Ministers approves the licence area proposed by the applicant, the Ministry of Economics announces a competition for a licence for HC E & P.

Any applicant can participate in the competition submitting an application to the Ministry of Economics.

The Competition Commission evaluates the applicants and determines the winner of the competition.

The Ministry of Economics issues a licence to the winner of the competition.

 

2.2. Licences for HC E & P for the lands, which are not the state property, are issued without a competition based on an application. The competition could be initiated by the landowner or his proxy.

Licensing procedure:

An applicant interested in hydrocarbon exploration and production, submits an application to the Ministry of Economics (Annex 1 to Regulations of the Cabinet of Ministers No. 597) for the determination of an E & P licence area.

The Cabinet of Ministers either approves or rejects the E & P licence area proposed by the applicant.

If the Cabinet of Ministers approves the licence area proposed by the applicant, the applicant submits an application to the Ministry of Economics (Annex 4 to Regulations of the Cabinet of Ministers No. 597) for the issue of a HC E & P licence.

The Ministry of Economics evaluates the applicant’s application in accordance with the evaluation criteria (Annex 5 to Regulations of the Cabinet of Ministers No. 597) and makes a decision regarding the issue of the licence or rejection of the application.

If the applicant’s application complies with the stated requirements, the Ministry of Economics issues the licence.
